TERMS OF USE

Use of this website and or placing an order with MZM International Inc. indicates your acknowledgement and acceptance of the terms & conditions as described below & above. Purchase & use of this website constitutes that an agreement has been entered into Travis County Austin, Texas between the customer and MZM International Inc.

JURISDICTION

You agree that any legal action brought against MZM International Inc. shall be governed by the laws of the State of Texas without regard to its conflict of law principles. You agree that the sole jurisdiction and venue for any litigation arising from your use of the website www.mzmperformance.com whether for purchase or inquiry shall be an appropriate federal or state court located in Travis County in the State of Texas.

If MZM International Inc. should initiate any suit or action against the buyer for non-payment of goods bought through this website, the buyer agrees to pay MZM International Inc. reasonable attorney’s fees. The buyer further agrees that if such suit or action is appealed to any appellate court and the seller is the prevailing party on the appeal, the buyer will pay MZM International Inc. reasonable attorney’s fees for such appeal.

PRICING & PAYMENT TERMS

An MZM representative will email or call you to confirm payment, availability, and shipping cost unless otherwise listed once order is processed online. You will not be billed until items have shipped. All orders will be shipped once payment is received. For customer convenience we accept VISA, MASTERCARD, AMEX and DISCOVER. Full payment is required on all Special orders. Shipping and handling charges will be included in all charges to the customer. All items are property of MZM Int'l until full payment has been received. Prices are subject to change without notice. You will be notified by phone or email on price changes before any charges are made to your credit card. All Texas residents are subject to 8.25% sales tax. If any error exists on pricing, we will correct all discrepancies at the time of processing. Customers will be notified of any errors and will have the option to cancel for a full refund or receive the item with the corrected price.

SHIPPING

Depending on the product(s) ordered and the destination of the order, certain shipping services may not be available. MZM International Inc. reserves the right to change the method of shipping suited to the product(s) ordered and the destination of the package(s). U.S.P.S. Priority Mail Service is only available for customers with a P.O. Box or APO/FPO Address. MZM International Inc. will not ship any orders via U.S.P.S. Priority Mail Service to a Normal Street Address. All Credit Card Orders can only be shipped to a VERIFIED Billing Address. Credit Card Orders will not be shipped until all information are verified and matched. The purchaser will pay all shipping charges unless otherwise stated. Orders generally ship within 24hrs unless notified otherwise by us at the point of sale.

REFUNDS, RETURNED or REFUSED SHIPMENTS

Return for exchange or refund will be allowed only within 7 calendar days from the date of receipt Shortage claims must be made within 2 working days of receipt date. All special order sales are final Any refused shipments sent back to MZM International Inc. does not constitute the right to a refund or credit. It is the customer’s responsibility to make all arrangements with MZM International Inc. for refused shipments. All Refused orders are subject to a 35% restocking charge. All Credit Card refunds will incur a 5% additional processing fee of the total invoice cost. All returned merchandise must be sent pre-paid and insured by the customer. No merchandise shall be returned to MZM without an RMA number (returned merchandise authorization) issued by MZM. The Return Authorization Number does not imply a replacement or refund, but only that MZM will inspect the merchandise based on your claim. All authorized return merchandise must be unused and in its original saleable packaging. No return or exchange on merchandise that shows signs of having been installed, modified, mounted, scratched, or defaced will be allowed. A refund, exchange, or core return will not be considered until all relevant items, hardware, and accessories have been returned to MZM International Inc. Original shipping and handling charges are not refundable Any returns sent C.O.D. will be refused. All custom entry fees and duty associated with any return or exchanges will be charged to the customer. A photocopy of your invoice showing the invoice number must accompany your return along with a written explanation and a contact telephone number where MZM may be able to reach you. It is the responsibility of the customer/installer to verify the correctness of size and application of all parts before installation. It is the customer’s responsibility to retain any and all invoices for their record and warranty claims.

FREIGHT CLAIMS & DAMAGED PACKAGES

All claims for damaged merchandise must be made with the shipping carrier. The customer accepts FULL RESPONSIBILITY on all claims for damaged packages with the shipping carrier. The customer must keep all shipping cartons and all packing materials for carrier inspection. MZM International Inc. cannot initiate any claims with the carrier ONLY if the package is damaged & refused with proper documentation through the carriers signature confirmation process listing “Refused due to shipping damage” NO Exceptions, as ALL carriers do not accept damaged packaging for shipping when received for pick up at MZM International Inc or any Vendors for that matter. If the package is refused with no documentation then MZM cannot process a claim AND the customer WILL incur a 50% re-stocking fee or the option to re-ship it at the customers cost. If refused with the proper listed documentation (“Refused due to shipping damage”), then MZM will honor a full refund or immediately exchange the items ordered once received, inspected & verified through the freight carrier that the case is refused due to shipping damage package. NO EXCEPTIONS, You the customer are responsible to make sure that this process is document by the carrier properly if you decide to refuse it due to shipping damage. Packages that are refused under these conditions are immediately expedited back to MZM & can take up to three weeks to process a refund, further the refusal under the shipping damage conditions are to be determined by MZM International Inc.& verified before any refund process occurs.

GUARANTEE

No warranty whatsoever will be valid if the defect was caused by customers abuse, negligence, or mishandling. Customer assumes all liability and risk out of the use of high performance products & or any product sold through this website. There is no warranty, expressed or implied for any parts under any circumstances. All merchandise sold by MZM Int'l is only subject to manufacturers warranty and conditions, if available and is subject to submission to the manufacturer for inspection and approval for repair or replacement of merchandise. The purchaser will be responsible for all shipping and handling fees. No labor or inconvenience may be included in any warranty claims. Customer shall notify MZM Int'l within 7 calendar days of any defects found. We reserve the right to repair or replace any items found to be faulty or defective and under warranty after part has been examined and tested by MZM International Inc.

Purchase and receipt of performance enhancing items or products acknowledges that you the customer assume all liability and risk out of the use of high performance products or any parts purchased from MZM International Inc. There is no warranty, expressed or implied, for any parts or product purchased for competition, track, school, & drag racing events, or vehicles involved in competitive & racing purposes on public roads or for any purpose at all. You the customer release MZM International Inc. of all responsibility for legal issues resulting from abuse, negligence or misuse thereof!

All engine modification components, except those that are exempt, have been designed and are intended for off-highway application. These components are legal in the Untied States for racing vehicles only, which may never be used on public roads and highways. Federal and many state laws prohibit the removal, modification, or rendering inoperable of any device or element of design affecting vehicle emission or safety in a vehicle used on public highways. Violation of such laws may subject the owner or user to a fine or penalty. Installation of these parts may void the warranty coverage, if any, on your vehicle. Vehicles modified by the use of performance parts may no longer be lawfully used on public highways. User assumes all cost and risks associated with all listed products by this website or purchased through MZM International Inc.
